What is “Hit-and-Run” or “Leaving the Scene”?

A hit-and-run is when the driver who caused an accident leaves the scene without providing the his or her information to the other persons involved. There are different levels of “leaving the scene” depending on the amount of damage, whethe anyone was injured, and the type of property damaged.

Penalties for “Hit-and-Run” and “Leaving the Scene”

The penalties for hit-and-run accidents in Virginia can vary depending on the severity of the accident. In general, however, hit-and-run drivers can face the following penalties:

For Misdemeanor Hit-and-Run:

  • Jail time of up to 12 months
  • Fine of up to $2,500
  • Suspension of your driver’s license for up to 6 months
  • Up to 6 demerit points on your license (same as DUI) resulting in increased insurance rates
  • For Felony Hit-and-Run, the punishments are the same, except for:
  • Prison for up to 10 years
  • In addition, this is also considered a crime of dishonesty, just like shoplifting or lying, which can result in loss of a job and make it more difficult to find a new job.

With so much on the line, you need to hire an attorney who specializes in these cases with a proven record for success.

This question matters because often times the senior attorneys pass off traffic cases to their less experienced associates. You want to be sure the attorney you researched, liked, and hired is actually going to be appearing for you in court.

Experience matters. While some attorneys are skilled at handling murders, white-collar crime, and other criminal cases, they may be inexperienced with traffic-related criminal offenses. Traffic defense is its own specialty in law.
